The following terms and conditions are in relation to any short-term holiday rental booking at: La Calahonda Holiday Home, Sitio de Calahonda, Mijas Costa.

LEGAL DISCLAIMER
The Contract entered into is between the owners of La Calahonda Holiday Home (who are referred to through this agreement as the “Owners”) and the person making the actual booking (who must be over 18 years old) and all the other members of your party as notified by you.
Any holiday rental contract entered into and confirmed in writing by the Owners is for a short-term holiday rental only and is defined by a start date (the arrival date and time) and an end date (the departure date and time).
The contract is only effective once the completed signed booking form is received with the required payment and written confirmation of acceptance has been sent by The Owners. You are required to check the confirmation carefully upon receipt. The Contract is subject to Scottish and English Law and the jurisdiction of the Scottish and English Courts, regardless of which country the person/s who made the booking is a resident in.

These terms and conditions will apply from their date of issue. Terms and conditions can be amended at any time without prior notice. These terms and conditions will govern any reservations already received as well as all new reservations.
Identity and Identification
As per the local tourism laws in the region of Andalucia, Spain, all registered self-catering holiday rental owners must collect identity information from all guests staying on their premises. This information is uploaded to the Guarda Civil (National Police Force) main portal within 24 hours of the arrival at the property so that there is a record of your stay in this region of Spain. We, therefore, require all guests to submit an image of their passport or ID card that clearly shows all necessary information, such as full name, passport number, etc. We will not retain any record of formal identity information after it is submitted, it will be deleted from our records. PAYMENT
A deposit of 50% of the total cost of the holiday booking rental is required when the booking is confirmed and the balance is due 56 days prior to check-in. For bookings made less than 56 days before arrival, full payment is required on the booking. We accept payments made by debit or credit card using Visa/Mastercard. The Owners, reserve the right to cancel a holiday booking where full payment has not been received in accordance with these terms.
If a booking is processed through a third-party booking platform such as Booking.com; Airbnb; VRBO or any other, they will have their own payment instructions to be followed.

PROPERTY RATES AND PRICING
Rates are subject to change without notice up until the booking has been confirmed by the Owner.
CANCELLATION
Forced cancellation to a holiday booking due to unforeseen circumstances – guests must inform the Owners of any cancellation immediately in writing by recorded delivery or by email. The following booking cancellation scale applies to all bookings unless otherwise stated at the time of booking:

Bookings cancelled at least 60 days before the start of stay will receive 100% refund

Bookings cancelled at least 30 days before the start of stay will receive a 50% refund

Bookings cancelled less than 30 days will receive 0% refund.
If a booking is processed through a third-party booking platform such as Booking.com; Airbnb; VRBO or any other, they may have a slightly different cancellation policy in place, to be observed.
LIABILITY
The Owners shall not be liable for death or any personal injury. No liability is accepted for any other damage, injury, loss, expense accidental or otherwise, or inconvenience to members of a booking party and/or your or their belongings, damage by or to any third party, or for damage to any motor vehicle or its contents which may be suffered, incurred, arise out of or in any way connected with the holiday rental. The terms of the Contracts (Rights of the Third Party) Act 1999 shall not apply to this contract.

INSURANCE
It is the responsibility of those staying in the property to ensure they have adequate travel insurance to cover all eventualities, losses, accidents what so ever. The Owners do not provide insurance coverage of any kind for guests!
CONFIRMED GUESTS
Only guests named on the rental agreement are permitted to stay in the property during the confirmed dates of the booking.
Names and addresses of all guests staying at the property must be given at the time of booking and only those guests will have access to the property.
Admittance may be refused by the Owners to those parties that have booked the holiday home if this condition is not observed. The Owners reserve the right to refuse or revoke bookings from parties that may in their opinion prove unsuitable as a result of their behavior or otherwise at the holiday home. All payments/ charges will be refundable in full on a daily basis, less, if applicable, the full cost of all repairs or replacements of any item in or to the apartment.
BOOKING ALTERATION
The Owners reserve the right, in the interests of safety or any other reason beyond their control to cancel or alter arrangements made for any booking. In the unlikely event that we have to cancel a booking for these reasons, we guarantee to return to you any payment/charges made in full including the damage deposit.
If we have a request from you to change the dates of the booking after confirmation has been issued, subject to the change being requested more than 6 weeks prior to the commencement of the rental agreement if The Owners have availability for those new dates there will be no charge for the change in booking.
FALSIFIED BOOKINGS
Any booking obtained under false pretense will be subject to forfeiture of advance payment, deposit, and/or rental money, and the party will not be permitted to check in. Note - The owners will at their discretion carry out ID checks using third-party companies from time to time to ensure the validity of the information given by the guest.
Falsified booking information is fraudulent and can be classed as a criminal offence. Any such evidence of criminal or fraudulent activity will be reported to the police department which will lead to a criminal investigation.

CARE OF THE PROPERTY AND DAMAGE DEPOSIT
All booking party members are responsible for taking care of the property during the rental agreement period. At the end of the rental agreement, the property must be left clean and tidy on departure (except for linen/towels to be laundered).
Any damages or breakages in the property are the joint responsibility of all guests.
As per the signed and binding rental agreement of which these terms and conditions form part, if the cost of damage incurred is higher than the damage deposit paid by you as part of your rental agreement, you fully agree to pay all necessary expenses in excess of your damage deposit in order cover the full cost to repair or replace anything damaged by you or your party. The cost is payable upon demand and, subject to any incurred losses, not limited to loss of rental, interest, and other consequential charges as may be incurred by The Owners.
Minor breakages are not usually charged for where it is reasonable to wear and tear, but guests must report any damage before departure.
The Owners operate a 100% non-smoking policy throughout the inside of the holiday home. Smoking is only permitted on the balcony with the balcony door closed over, to stop smoke from entering the property. In the event of any member of the party breaching the smoking policy, The Owners will make a charge of £200 for additional cleaning and damage caused as a result.
A £50 charge will be levied if keys are taken from the property on departure this is for replacements and inconvenience.
A damage deposit of £200 is payable with the final balance rental payment for bookings made directly via this website.
The deposit is NOT part of the cost of renting the property and is fully refundable within (14) days of your departure date from the property, provided the following provisions are met:
• No damage is found to the property or any of its contents, beyond normal wear and tear.
• No charges are incurred due to illegal activity, pets, or collection of rent or services rendered during the stay.
• All debris, rubbish, and discards are placed in the rubbish bin out on the main street, and soiled dishes are cleaned.
• All keys are left in the drawer in the apartment where you received them from or returned to the owner or their elected agent and the apartment is left fully locked as per instructed.
• All charges accrued during the stay are paid prior to departure.
• No linens are lost or damaged.
• NO early arrival or late departure.
• The apartment is left in a clean and tidy manner that will not require us the owners to provide additional cleaning resources
• The renter is not evicted by the owner (or representative of the owner) or local law enforcement.
• That there has been no smoking of any kind in the apartment

RIGHT OF ENTRY
The Owner reserves the right to enter the property at any reasonable time for the purpose of emergency repairs should they become necessary. The Owners will respect a guest's right to privacy and confidentiality and accommodate any reasonable request as to timing or arrangements in this situation.
The property must be securely locked when the property is unattended and care taken not to expose the property to any such risks as fire or flooding. All guests are completely responsible for ensuring their safety as well as the safety of the property and all it contains.
The Owner reserves the right to retake possession of the property at any time for any reasonable reason and in particular where serious misconduct has arisen in or around the property.

SPATIAL AWARENESS/NOISE POLLUTION
All guests must be considerate and mindful of all other neighboring apartment owners/guests at all times. The property is part of a small quiet residential complex and only welcomes guests with this same mindset!

HEN/STAG PARTIES OR EVENTS
Unfortunately, we do NOT accept Hen/Stag party guests at the property. Guests at the property are not allowed to host any events!

DESCRIPTIONS
The Owners of the property oversee the management of the property and make every effort to describe it fairly but also anticipate possible changes. All information in our brochures/manuals and on this website is given in good faith, and is correct at the time of publication. However, the Owners cannot be responsible for changes beyond their control or which may become known after publication without reasonable opportunity for updating the website or other locations where the property and its information is advertised.

INCLUSIVE FEES
Rates include a one-time linen & towel setup. The per night/week charge will include all utility and exit cleaning charges except where our terms and conditions have not been followed. Any additional supplies/service requests may incur additional charges and will be agreed upon in writing (email) prior to confirmation of the request.

NO DAILY HOUSEKEEPING SERVICE
While linens and bath towels are included in the property, daily maid service is not included in the rental rate. However, if you require a cleaning service during your stay this can be supplied at an additional cost and must be requested in advance. We do not permit bath towels or linens to be taken from the property to the pool or the beach. We do have a few beach towels available for guest use. Beach towels must be left in a good condition.

FIREPLACE
The living room fireplace cannot be used and is ornamental only. Please do not throw any paper or other combustible materials in the fireplace or attempt to light the fire.

COMPLAINTS PROCEDURE
The complaints procedure means you can report a problem at any time during your break, the earlier the better, and not wait until the end of your holiday!
Our goal is for all guests to have a wonderful break whilst staying on the property. Guests must inform the Owner immediately if a problem arises and every effort will be made to rectify the issue as soon as possible, to allow an enjoyable continuation of the rest of the holiday.
In the event of a breakdown of domestic appliances, plumbing, wiring, or any unforeseen occurrence or circumstance the Owners will not be required to pay any compensation, or expenses of any kind, but will endeavor to resolve any issue as soon as possible.
Guests can make a formal complaint by completing a complaints form (on the property) and submitting it to the address on the form.

PET POLICY
Guide dogs are always accepted without charge but must be declared on the booking form. No other pets may be admitted to the apartment at any time unless pre-arranged at the time of booking!!.

CHILDREN'S TOYS – BOOKS – GAMES
Children are welcome to use the beach toys available on the property, with their parent's/adult's permission, but the Owners of the property offer no guarantee as to the conditions of such toys and take no responsibility for their use.
Guests are welcome to use board games and reading books in the apartment. Guests are also permitted to take any reading books out of the property and may also take them away if they wish at the end of their holiday.
PARKING
Parking on the street is permitted at the property and is free. Any illegally parked cars are subject to towing and applicable fines/towing fees are the sole responsibility of the vehicle renter or owner. The property Owner accepts NO responsibility for any issues related to car parking, fees/fines, damage, etc.

POOL AND GARDENS
There should be NO children left unattended in the gardens/pool area at any time this is prohibited by law in Spain. Fires and barbeques in the gardens or balcony are Not Allowed. Please observe the “poolside rules” in the pool/garden area at all times.

PRIVACY POLICY
How we use your information - If you would like a copy of our Privacy Policy, please request this in writing by emailing help@lacalahonda.com
Note – As per the conditions of our tourist license in Andalucía, the Administration of the Junta de Andalucía can request to see this completed booking form and its full contents anytime up to 12 months from your arrival date to the property.

ACCESS INFORMATION
We will confirm access to the property on a booking-by-booking basis as this can sometimes be based on the time of arrival and the country you are traveling from.

WRITTEN EXCEPTIONS
Any exceptions to the policies mentioned above must be approved by the owners in writing and in advance of your booking being confirmed.
